I understand that my consent to these provisions is given in consideration of the acceptance of this registration and for being permitted to participate in this event. I am a voluntary participant in this event. *
I HEREBY ASSUME FULL AND COMPLETE RESPONSIBILITY FOR ANY INJURY OR ACCIDENT WHICH MAY OCCUR DURING MY PARTICIPATION IN THIS EVENT OR WHILE ON THE PREMISES OF THIS EVENT (BOTH BEFORE AND AFTER THE EVENT), AND I HEREBY RELEASE AND HOLD HARMLESS AND COVENANT NOT TO FILE SUIT AGAINST CURE SMA, ITS CHAPTERS, OFFICERS, STAFF, VOLUNTEERS, REPRESENTATIVES AND ANY AFFILIATED INDIVIDUALS, ANY EVENT SPONSORS AND THEIR AGENTS AND EMPLOYEES, AND ALL OTHER PERSONS OR ENTITIES ASSOCIATED WITH THIS EVENT (THE "RELEASEES"), INCLUDING BUT NOT LIMITED TO ALL CITY AND STATE GOVERNMENTS, FROM ANY LOSS (OF PERSONAL PROPERTY, GOODS OR OTHERWISE), LIABILITY OR CLAIMS I MAY HAVE ARISING OUT OF MY (OR MY CHILD'S) PARTICIPATION IN THIS EVENT (BOTH BEFORE AND AFTER THE EVENT) INCLUDING PERSONAL INJURY OR DAMAGE SUFFERED BY ME OR OTHERS, WHETHER SAME BE CAUSED BY FALLS, CONTACT WITH PARTICIPANTS, CONDITIONS OF THE COURSE, NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
If I am injured while participating in this Cure SMA event, I consent to emergency medical care being provided to me, but recognize that nothing in this authorization creates a duty or obligation by any of the releasees to provide me with emergency medical care. I further understand and agree that any and all costs or fees associated with any emergency medical care or medical services provided to me will be at my sole cost and expense and I may choose to carry personal medical insurance to cover any such costs at my sole discretion.
If I do not follow all the rules of this event, I understand that I may be removed from the event. I give my full permission to Cure SMA and its chapters, and their corporate sponsors, Inc., to use or authorize others to use any photographs, videotapes, audiotapes, or other recordings of me that are made during this event on social media including, but not limited to Cure SMA's Facebook, Twitter, YouTube, and Fundraising Stars blog as well as in Cure SMA online and print publications. I further release the Releasees of any and all costs, liabilities, or damages that I may have resulting from or relating to such use.
COVID-19 SAFETY ACKNOWLEDGEMENT -- LIABILITY WAIVER AND RELEASE OF CLAIMS COVID-19 SAFETY INFORMATION:
Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, Cure SMA has put in place preventative measures to reduce the spread of COVID-19. However, Cure SMA cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19. Because of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in Cure SMA events and/or other face to face fundraising activities. By attending a Cure SMA event, you certify that you do not fall into any of the following categories:
1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others.
2. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.
DUTY TO SELF-MONITOR:
Participants and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, contact Cure SMA at fundraising@curesma.org if he/she experiences symptoms of COVID-19 within 14 days after participating or volunteering with Cure SMA.
COVID-19 EVENT POLICIES:
Participants agree to abide by Cure SMA’s event policies to prevent the spread of COVID-19 including:
- Masks are not required for fully vaccinated people; unvaccinated people are required to wear a mask and maintain physical distancing while participating in a Cure SMA event.
- Regardless of vaccination status, Cure SMA encourages event attendees to maintain good hygiene practices (hand washing, sanitizing) and consider maintaining physical distancing to limit the spread of infectious diseases, including COVID-19, that may endanger our community.
Policies are subject to change based on any update to local, state, or federal guidelines.
LIABILITY WAIVER AND RELEASE OF CLAIMS:
I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation and/or voluntarism with Cure SMA, and I willingly engage in Cure SMA events and/or other fundraising activities (the “Activity”).
I understand that this Waiver and Release may be stored electronically and agree that a copy is authentic and admissible as evidence in any future dispute or proceeding.
RELEASE AND WAIVER.
I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST CURE SMA AND ITS AFFILIATED PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH THE ACTIVITY.
*An adult must accompany children up to age 18.
Note: This event will occur rain or shine. We reserve the right to cancel in extreme circumstances, in which event there will be no refunds; rather your entry fee will be used as a donation to Cure SMA.
